Terms
These terms cover your use of Scenario Book for Jira, which we call "the app". "We" and "us" mean Gold Standard Web LLC, a Wisconsin limited liability company, of 7530 39th Ave, Kenosha, WI 53142. "You" means the organization whose Atlassian site the app is installed on.
Installing or using the app means you accept these terms. If you're accepting on behalf of an organization, you're saying you're allowed to.
Buying the app goes through Atlassian
You buy, renew and cancel the app through the Atlassian Marketplace, and Atlassian's Marketplace Terms of Use cover that part: price, billing, taxes, renewals and refunds. Where those terms and these ones disagree about buying or billing, Atlassian's terms win.
What you pay and how long your license runs is whatever your Atlassian subscription says.
What you may do with the app
While your license is active, you may install and use the app on the Atlassian sites your license covers, for your own organization's work.
You may not:
- resell, rent or sublicense the app;
- take it apart to rebuild it, except where the law says you may despite this;
- remove or hide any notice of who made it;
- use it to do something Atlassian's own terms don't allow.
What the app does, and what stays your decision
The app stores your teams' test scenarios in your Atlassian site, shows them on your Jira stories, and, if a project admin turns on pipeline sync, works with your own build pipeline to keep them in step with your code repository.
The app never connects to your repository. Your pipeline does, with credentials you give it, and it decides what to commit and where. The scripts we publish put changes on a separate branch for review. You decide whether to merge them, and you're responsible for what your pipeline commits.
Turning on pipeline sync copies a project's feature files into Jira project properties, which anyone who can browse that project can read. You decide whether to turn it on.
Your data
Your scenarios are yours. You're responsible for what you put in them, including any personal or confidential information, and you give us only the permission the app needs to store, show, copy and sync them for you.
The app runs entirely on Atlassian's infrastructure. It has no servers of its own and sends nothing outside your Atlassian site. The Privacy page sets out what it stores and for how long, and the Security page covers how it is built.
If your license lapses, editing and sync stop, and reading and export keep working while the app is installed, so you can take your scenarios with you.
Support
Critical issues, meaning the app overwrote or lost a scenario, or showed files to someone who shouldn't see them, are answered within 24 hours. Everything else within 5 business days. Business days are Monday to Friday, United States Central Time, not counting United States federal holidays.
Support is in English, by email, to the address on the Support page.
No warranty
THE APP AND THE PIPELINE SCRIPTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. WE SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS.
The app is built to keep both sides when Jira and your repository disagree and to let a person choose. That is how it is designed, not a promise that no change will ever be lost. Keep your repository's history, and review what your pipeline commits.
Limit on what we owe you
TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER SIDE IS LIABLE TO THE OTHER FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OR LOST OR CORRUPTED DATA, EVEN IF TOLD SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE EVENT THE CLAIM IS ABOUT.
Some states don't allow some of these limits. Where that's so, these limits apply as far as the law allows and no further.
Your part
You'll keep us safe from any claim brought by someone else that arises out of your use of the app in a way these terms don't allow, or out of your breach of these terms, including reasonable legal costs. We'll tell you about any such claim promptly and let you handle it, and we won't settle it without your agreement.
Ending
You can stop using the app at any time by uninstalling it or canceling through Atlassian.
Before you uninstall, export your projects as .zip files. On uninstall the app removes the copies it published to your projects, and Atlassian deletes the app's stored data 28 days after the uninstall. Your repository is not touched.
We may stop selling or supporting the app. If we do, we'll say so on the Marketplace listing, and your license runs out its paid term.
We may end your license if you breach these terms and don't fix it within 30 days of us telling you.
Not an Atlassian product
Scenario Book for Jira is made by Gold Standard Web LLC, a Wisconsin limited liability company. It is not made, endorsed or supported by Atlassian. Atlassian, Jira and Bitbucket are trademarks of Atlassian. Atlassian is not a party to these terms and owes you nothing under them. The app is not affiliated with the Cucumber project or with any other test tool it works with.
Changes to these terms
We may update these terms. The current version is always on this page. If a change matters to you, we'll note it on the Marketplace listing. Carrying on using the app after a change means you accept it.
Law, and where disagreements go
These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply.
Any dispute goes to the state or federal courts located in Kenosha County, Wisconsin, and both sides agree those courts may hear it.
The rest
If a part of these terms can't be enforced, the rest still stands. Not enforcing something once doesn't waive it. These terms, plus the Privacy page, the Security page and Atlassian's Marketplace Terms of Use, are the whole agreement about the app. You may not transfer these terms without our written agreement; we may transfer them to a buyer of the business.
